Terms of Use

These Terms of Use ("Terms") govern your use of the Equalizer iOS application ("the App"), developed and published by Md Khaled Hasan ("we", "us"). By downloading or using the App you agree to these Terms. These Terms supplement, and where applicable incorporate, Apple's Standard End User License Agreement.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, for personal, non-commercial purposes, in accordance with these Terms and the App Store Terms of Service.

The App's core features are free. Additional features ("Premium") are available through auto-renewable subscriptions purchased via your Apple ID:

3. DRM-protected content

The App applies its equalizer and audio effects to DRM-free music — files you import and DRM-free tracks in your device's music library. Audio protected by digital rights management (including streaming-subscription content) cannot be processed by the App or by any third-party iOS app; such tracks are identified in the App and play without effects. This limitation is disclosed in the App before any purchase, and Premium is sold on that basis.

4. Your content

You are responsible for the audio files you import into the App and must hold the necessary rights to use them. The App does not upload your files anywhere; they remain on your device. You agree not to use the App to infringe the intellectual-property rights of others.

5. Acceptable use

You agree not to reverse-engineer, decompile, resell, or redistribute the App; not to circumvent its purchase mechanisms; and not to use it in any unlawful manner or in violation of the App Store Terms of Service.

6. Hearing safety

The App can increase playback volume beyond normal levels. Listening at high volume for extended periods may damage hearing. You are responsible for choosing safe listening levels; a built-in limiter reduces distortion but does not make loud listening safe.

7. Intellectual property

The App, including its design, code, presets and branding, is owned by us and protected by applicable intellectual-property laws. These Terms grant you no rights other than the license in Section 1. Apple, Apple Music and the App Store are trademarks of Apple Inc.; the App is an independent product and is not affiliated with or endorsed by Apple.

8. Disclaimer of warranties

The App is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the App will be uninterrupted, error-free, or compatible with every audio file, accessory, or iOS version.

9. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability for any claim shall not exceed the amount you paid for the App in the twelve months preceding the claim.

10. Apple's role

These Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the App and is not responsible for any claims relating to it. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Changes and termination

We may update the App, its features, its prices (for future billing periods), and these Terms. Continued use after an update constitutes acceptance. We may terminate the license if you materially breach these Terms. You may stop using the App at any time by deleting it; active subscriptions must be cancelled separately as described in Section 2.

12. Governing law

These Terms are governed by the laws of your country of residence to the extent required by local consumer law, and otherwise by the laws applicable to the developer's place of business, without regard to conflict-of-law rules.
